“REEL” MAN’S GIVEAWAY
Official Rules

1. GENERAL: No purchase necessary. MAKING A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Void where prohibited or restricted by law. All applicable federal, state, and local regulations govern this contest.
2. ELIGIBILITY: The “Reel” Man’s Giveaway (“Giveaway”) is open only to legal U.S. and North Carolina residents who reside within the Wilmington, NC Metro area as determined by Arbitron and who are 21 years of age or older. Limit one Qualifier per household. Limit one Qualifier per family. Prizes are non-transferable. Employees of 98.3/Sunrise Broadcasting LLC/Capitol Broadcasting Company, Inc, Marine Warehouse, Handee Hugo, Tex’s Tackle, RA Jeffreys, Step up for Soldiers, and their respective advertising and promotional agencies, and each of their parents, subsidiaries, affiliates, representatives, and agents, and their officers, directors, and employees (collectively, “Giveaway Entities”), members of their immediate families, and the members of the same households of such individuals are not eligible to participate. The term “immediate families” includes spouses, grandparents, parents, siblings, children and grandchildren. No groups, clubs, or organizations may participate in this Giveaway or reproduce or distribute any portion of these Official Rules to their members. Employees of any media outlet and members of their families are not eligible to participate. Proof of age, identity, and eligibility must be furnished to Sponsors upon request. All entry form information must be complete and accurate. Sponsors will not award a prize to anyone not meeting eligibility requirements at the time of entry. Surf 98.3/Sunrise Broadcasting LLC/Capitol Broadcasting Company, Inc. reserve the right to disqualify any entrant if these Official Rules are not followed.
3. HOW TO ENTER AND BECOME A QUALIFIER: By entering, you agree to comply with all applicable laws and these Official Rules, and you agree to abide by all decisions of the Sponsors. The Giveaway entry period begins on January 11, 2010, and ends on March 26, 2010 (“Entry Period”). All times in these rules refer to Eastern Time.
There are four (4) ways to enter for a chance to become a Qualifier in the Giveaway. Qualifiers will then have an opportunity for a chance become a Finalist and a chance to win the Prize. Below are the four ways to qualify:
a. On-Air. Participants must listen weekdays to Surf 98.3 for a sounder indicating that listeners have an opportunity to call for a chance to become a Qualifier. There will be one opportunity for listeners to call for a chance to become a Qualifier per on-air shift each weekday (three opportunities per weekday) during the Entry Period. Surf 98.3 will announce that the sounder is coming shortly before the sounder is played. The sounder will indicate the caller number that entrant must be in order to qualify. The entrant who is the designated caller following the sounder will be a Qualifier. There will be a total of up to one hundred sixty-five (165) on-air Qualifiers.
b. Traveling Thirsty Thursday. Participants will have the opportunity to become an instant Qualifier by participating in Traveling Thirsty Thursdays. On Traveling Thirsty Thursdays, participants in attendance at that week’s Traveling Thirsty Thursday event must complete a Giveaway entry slip and place the slip in a registration box in order to have a chance to become a Qualifier. At the end of each Traveling Thirsty Thursday, Sponsors will randomly draw one name from that day’s entry box and that person will be a Qualifier. Entrant must be present at the Traveling Thirsty Thursday event at the time of drawing to qualify; if entrant is not present, Sponsor will draw another name from among that day’s entries and that person will be the Qualifier. There will be a total of up to eleven (11) Traveling Thirsty Thursday Qualifiers.
Traveling Thirsty Thursdays are scheduled to be held each Thursday during the Entry Period from 5:00 p.m. to 8:00 p.m. To learn the location of the Traveling Thirsty Thursday for the current week, participants must listen to WSFM 98.3 that week (Mon. through Thurs. during the Entry Period) to hear an on-air announcement about that week’s Traveling Thirsty Thursday location or log on to www.surf983.com during the week (Mon. through Thurs. during the Entry Period) and click on the “TTT” link to learn the location for the week.

Dates, times, and locations of Traveling Thirsty Thursdays are subject to change or cancellation in the sole discretion of Sponsors.

c. Boat Stops. Participants will have the opportunity to become an instant Qualifier by participating in “boat stops.” There will also be up to six (6) boat stops, one at each of six (6) area Handee Hugo locations, as described below.
Each boat stop will last one (1) hour. During that hour, participants in attendance must complete a Giveaway entry slip and place the slip in a registration box in order to have a chance to become a Qualifier. At the end of each boat stop hour, Sponsors will randomly draw one name from that boat stop’s entry box and that person will be a Qualifier. Entrant must be present at the relevant boat stop at the time of drawing to qualify; if entrant is not present, Sponsor will draw another name from among that boat stop’s entries and that person will be the Qualifier.

The boat stop locations and dates are scheduled as follows:
• Friday January 15th, from 5pm-6pm at 5629 Carolina Beach Road, Wilmington, NC
• Friday January 29th, from 5pm-6pm at 304 Eastwood Road, Wilmington, NC
• Friday February 12th, from 11am-12 noon 6170 Ocean Hwy 17/87, Winnabow, NC
• Friday February 26th, from 4:30pm-5:30pm 2540 Castle Hayne Road, Wilmington, NC
• Friday March 12th, from 4:30pm-5:30pm 5043 Southport/Supply Road, Southport, NC
• Friday March 26th, from 4:30pm-5:30pm 5002 Market Street, Wilmington, NC

Dates, times, and locations of boat stops are subject to change or cancellation in the sole discretion of Sponsors.
One instant Qualifier will be selected at each boat stop for a total of up to six (6) boat stop Qualifiers.
d. Handee Hugo Entry Boxes. Participants may enter for a chance to become a Qualifier by visiting one of the following twelve (12) Handee Hugo/Crown/Fast Fare locations and completing and submitting an entry slip in the Giveaway registration box located there:

At the end of the Entry Period, one (1) Qualifier will be randomly drawn from among eligible entries received at each of the twelve Handee Hugo registration boxes. There will be a total of up to twelve (12) Qualifiers selected by this method (one from each registration box).
There will be a total of up to one hundred ninety-four (194) Qualifiers for the Giveaway.
To be eligible, entries must be received during the Entry Period.
Sponsors may not verify receipt of entries. Entries become property of Sponsors and will not be returned. Limit one entry per person per email address. Incomplete and additional entries beyond the entry limit are void. Sponsors are not responsible for entries that are lost, late, misdirected, incomplete, incomprehensible, illegible, damaged, undeliverable or delayed. Photocopied and mechanically generated entries that are detected as such are void. Entries generated by any automated means and detected as such are void. In the event of a dispute, electronic entries and other entries requiring the identification of an email address will be deemed to have been submitted by the authorized account holder of the e-mail address at the time of the entry. The authorized account holder is the person to whom the applicable internet service provider or other organization (such as a business or educational institution) has assigned the e-mail address. An online entrant must have a valid e-mail address, and it is entrant’s responsibility to update Sponsors of any change in e-mail address.
4. HOW TO WIN:
Sponsors will contact Qualifiers (using information provided by entrants) and notify Qualifiers of the Giveaway drawing location and date (“Giveaway Event”). The Giveaway Event will be held at Wild Wing Café, 1331 Military Cutoff Road, Wilmington, NC, from 2pm – 4pm on April 3, 2010. To participate for a chance to become a Finalist and win, each Qualifier must complete an entry slip upon “check in” at the Giveaway Event location no later than 3:00 p.m. Those entry slips will be placed in a registration box. At approximately 3:15 p.m., Sponsors will randomly draw ten (10) names from among all eligible entries submitted by Qualifiers and placed in the registration box at the time of drawing. Those ten people will be the Finalists. Sponsors will give each Finalist a key. There will be a lock on the boat trailer, and only one key will open the lock. The Finalist who has the key that opens the lock wins the grand prize, the JV 17 CC boat from Marine Warehouse (the “Prize”). There will be only one Prize winner. Qualifiers must be present at the Giveaway Event at the time Finalists are selected to become a Finalist. Finalists must be present at the Giveaway Event at the time keys are distributed and the boat lock is tested to win.
Giveaway Event time, date, and location is subject to change in Sponsors’ sole discretion.

Sponsors are not responsible for incomplete, incomprehensible, illegible, or out-of-service contact information.
Winners may be required to sign and return appropriate forms and/or documentation, including, without limitation, any documents necessary to transfer to Sponsors any intellectual property rights (e.g., copyright, trademark, etc.) in the entry materials, an Affidavit of Eligibility, a Liability Release and/or where legally permissible a Publicity Release prior to receipt of Prize. For prizes valued at $600 or greater, winner must provide winner’s Social Security Number for tax purposes. Failure to sign and return such forms within the requisite timeframe may result in disqualification of the Winner and forfeiture of the Prize.

Winner (and guests, if applicable) will be required to sign a standard liability/publicity release form confirming compliance with these rules and releasing the Giveaway Entities and their respective related and affiliated companies and the directors, officers and employees of each of them (collectively, “Releasees”) from any damage or loss that may result from entering this contest or accepting and/or utilizing any Giveaway prize. If completed release form is not timely returned or is returned incomplete, winner will be automatically disqualified and another winner may, at Sponsors’ sole discretion, be drawn at random from all remaining eligible entries.

5. PUBLICITY RELEASE: Except where prohibited, entry in the Giveaway constitutes each entrant’s consent for Sponsors to use, publish, reproduce and distribute for any purpose, including publicity, promotion and advertising, in any media (including without limitation, print, Internet, television, radio, and offline), each Winner’s name, city, photograph, likeness, biographical information, voice, or image, each in perpetuity without further compensation, credit, or right of review or approval.

6. PRIZES: The Prize winner of the “Reel” Man Giveaway will be offered one (1) Carolina Skiff JV 17 CC boat from Marine Warehouse. Specifications of the Carolina Skiff are as follows:

• Beam: 63.5”
• Boat weight: 750 lbs.
• Weight capacity: 1015lbs.
• Horsepower: 50hp
Approximate total retail value of Prize: $12,335.02.
All charges, fees, and costs not specifically included in the Prize descriptions above, including but not limited to personal incidental items, transportation, hauling, parking, taxes, souvenirs, gratuities, and licenses, are the responsibility of the respective Prize Winner(s) (and guests, if applicable).

Winner must be present at the Giveaway Event, as described in section 4 above, to win. If the winner is not able to claim and leave with boat on the day of the Giveaway Event, winner must pick up the Prize at Marine Warehouse Center, 6921 Market Street, Wilmington, NC 28411 no later than the close of business on May 3, 2010. To claim Prize, winner must provide valid photo identification, acceptable to Sponsor in its sole discretion. Prize is non-transferable by winner. No cash redemption or Prize substitution allowed by winner. Sponsors reserve the right to substitute a Prize of equal or greater value in the sole discretion of Sponsors if the Prize or any component thereof is unavailable for any reason.

7. ODDS: Odds of becoming a Qualifier depend upon the number of eligible entries received during the Entry Period. Odds of becoming a Finalist are at least 1 in 194. Odds of a Finalist winning the Prize are at least 1 in 10. Due to the time delay that exists between WSFM’s analog and digital over-the-air signals and the time delay that exists between WSFM’s analog over-the-air signal and WSFM’s online webcast, listeners who listen to the WSFM digital or online signal may hear their name later than listeners listening to WSFM’s analog over-the-air signal. As a result, the odds of a digital or online listener winning may be diminished.
8. TERMS AND CONDITIONS; LIMITATION OF LIABILITY: Participants are responsible for complying with all applicable federal, state, and local laws and regulations and with these Official Rules, and by entering, participants agree to be bound to these Official Rules. Any attempt by an entrant or other party to tamper with the proper administration of the Giveaway will disqualify the entrant and may result in civil or criminal action against the entrant or other party and may result in the discontinuation, suspension, or cancellation of the Giveaway. WINNERS AND ENTRANTS AGREE, EXCEPT WHERE PROHIBITED BY LAW, TO RELEASE AND DISCHARGE, HOLD HARMLESS AND INDEMNIFY THE GIVEAWAY ENTITIES, AND ALL OTHERS ASSOCIATED WITH THE DEVELOPMENT AND EXECUTION OF THIS GIVEAWAY, FROM ANY AND ALL TAX LIABILITY THAT MAY BE IMPOSED OR ASSOCIATED WITH RECEIPT OR USE OF THE PRIZES, AND FROM AND AGAINST ANY AND ALL CLAIMS, ACTIONS, PROCEEDINGS, AND LIABILITY FOR ANY DAMAGES, EXPENSES, FEES, INJURY OR LOSSES (INCLUDING PERSONAL INJURY OR DEATH) SUSTAINED IN CONNECTION WITH THE RECEIPT, OWNERSHIP, OR USE OF THE PRIZE OR WHILE TRAVELING TO, PREPARING FOR, OR PARTICIPATING IN ANY GIVEAWAY-RELATED OR PRIZE-RELATED ACTIVITY. Sponsors are not responsible for any printing, typographical, mechanical or other error in the printing of the offer, administration of the Giveaway or in the announcement of the Prize. Winner’s guest(s), if applicable, may be required to execute a liability and publicity release prior to the Winner’s receipt of the Prize. Sponsors retain the discretion to make all decisions regarding the interpretation and application of these Official Rules. All decisions of Sponsors are final and discretionary. In the event the selected Winner(s) of the Prize are/is ineligible or refuse(s) the Prize or, if the selected Winner fails to timely claim the Prize, the Prize will be forfeited and Sponsors, in their sole discretion, may randomly select an alternate Winner from remaining entries (time permitting), or may elect not to award such Prize to an alternate Winner, where permitted. For prizes valued at $600 or greater, Winner must provide his or her Social Security Number for tax purposes. Prizes may be considered income, and any and all taxes associated with Prizes are the responsibility of the Winner(s).

9. FORCE MAJEURE, DISCLAIMER/INTERNET: If for any reason, the Giveaway is not capable of running as planned for any reason, including infection by computer virus, bugs, tampering, and unauthorized intervention, fraud, technical failures, acts of God, war, terrorism, government regulation, disaster, fire, strikes, civil disorder, or any other causes beyond the control of the Sponsors which corrupt or affect the administration, security, fairness, integrity of the Giveaway, the Sponsors reserve the right in its discretion to disqualify any individual it believes has tampered with the entry process, and/or cancel, terminate, modify or suspend the Giveaway and to select Winner(s) from eligible entries received as of the termination date. Sponsors may prohibit an entrant from participating in the Giveaway if it determines that said entrant is attempting to undermine the legitimate operation of the Giveaway by cheating, hacking, deception or other unfair playing practices or intending to abuse, threaten or harass other entrants. Caution: Any attempt by a participant to deliberately damage any Web site or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil laws and should such an attempt be made, Sponsors reserve the right to seek damages from any such participant to the fullest extent of the law. The Giveaway Entities (i) assume no responsibility for any error, omission, interruption, deletion, defect, delay in acquisition, operation or transmission of, communications line failure relating to, theft or destruction or unauthorized access to, or alteration of, entries; (ii) are not responsible for any problems relating to or technical malfunction of any communications network or lines, computer on-line systems, servers, or communications service provider, computer or other equipment, hardware, software, failure of any entry information to be received by the Sponsors on account of technical problems, human error or traffic congestion any communications system, on the Internet or at any website, or (iii) are not responsible for any combination of the foregoing, including any injury or damage to the participant’s or any other person’s computer or other device related to or resulting from participation or downloading of any materials in this Giveaway. SPONSORS MAKE NO WARRANTY, GUARANTEE, OR REPRESENTATION OF ANY KIND CONCERNING ANY PRIZE, AND SPONSORS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTY OF MERCHANTABILITY, WARRANTY OF FITNESS, AND ANY OTHER IMPLIED WARRANTY. Sponsors are not responsible for cancellations, postponements, or delays.

10. CHOICE OF LAW: Participants agree that this Giveaway is governed solely by the laws of the United States. Any claims arising out of or relating to this Giveaway or any other Prize may be brought only in a federal or state court in North Carolina. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsors in connection with the Giveaway shall be governed by and construed in accordance with the laws of the State of North Carolina, without giving effect to any choice of law or conflict of law rules or provisions (whether of North Carolina or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than North Carolina. If any provisions of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

Sponsors reserve the right to change, alter, or amend these Official Rules as necessary, in their sole discretion, to ensure the fair administration of the Giveaway or to comply with applicable law.
